These Terms & Conditions (“Terms”) govern your access to and use of the Mahalli mobile application, website, and related services (collectively, the “Platform”).

Mahalli is operated by The 1 Percent Solutions, Commercial Registration No. 102103-1, with its headquarters in Seef, Kingdom of Bahrain.

By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, do not use Mahalli.


1. Definitions

  • “Mahalli”, “we”, “us”, or “our” refers to The 1 Percent Solutions.
  • “User” refers to any person who accesses or uses the Platform.
  • “Buyer” refers to a User who purchases goods or services.
  • “Seller” refers to a User who lists or sells goods or services.
  • “Order” refers to a transaction initiated through the Platform.
  • “Escrow” refers to funds temporarily held by Mahalli until order completion.

2. Platform Role & Nature of Service

Mahalli is a technology marketplace platform that enables Buyers and Sellers to connect and transact.

Mahalli:

  • Is not a seller, merchant, or service provider
  • Does not manufacture, own, or inspect listed items
  • Does not guarantee the quality, legality, or availability of listings

All transactions are concluded directly between Buyers and Sellers.


3. Eligibility & Accounts

  • The Platform is available to users of all ages.
  • Users must provide accurate, complete, and current information.
  • You are responsible for all activity conducted through your account.
  • Mahalli may suspend or terminate accounts at its discretion for violations of these Terms.

4. Listings & Seller Obligations

Sellers agree to:

  • Provide accurate and lawful descriptions of goods or services
  • Ensure items comply with applicable Bahraini laws and regulations
  • Fulfill orders in a timely and professional manner
  • Honor prices, availability, and delivery commitments

Mahalli reserves the right to remove or restrict listings at any time.


5. Orders & Payments

5.1 Online Payments

  • Online payments are processed through Tap Payments
  • Mahalli does not store full payment card details

5.2 Cash Payments

  • Cash payments are handled directly between Buyer and Seller
  • Mahalli bears no responsibility for cash transactions

5.3 Escrow

  • For online payments, Mahalli may hold funds in escrow
  • Funds are released to the Seller once delivery is confirmed
  • Mahalli may delay or withhold release in cases of disputes, fraud, or policy violations

6. Delivery & Fulfillment

  • Sellers are solely responsible for delivery and fulfillment
  • Delivery timelines are estimates only
  • Mahalli is not liable for delays, losses, or damages during delivery

7. Cancellations, Refunds & Disputes

  • Cancellation and refund eligibility may vary by Seller
  • Mahalli may facilitate dispute resolution but is not obligated to do so
  • Decisions related to escrow release are final unless required otherwise by law

8. Communications

Users consent to receive:

  • Transactional notifications (email, SMS, push notifications)
  • Service-related communications

Marketing communications may be sent where permitted and can be opted out of.


9. Prohibited Conduct

Users must not:

  • Use the Platform for unlawful or fraudulent purposes
  • Post false, misleading, or infringing content
  • Interfere with Platform operations or security
  • Circumvent payment or escrow mechanisms
  • Harass, abuse, or harm other users

Violations may result in suspension or termination.


10. Intellectual Property

  • All Platform software, branding, and content are owned by or licensed to Mahalli
  • Users may not copy, modify, or exploit Platform content without authorization
  • Users retain ownership of content they upload but grant Mahalli a non-exclusive license to use it for Platform operations

11. Account Suspension & Termination

Mahalli may suspend or terminate accounts:

  • For violation of these Terms
  • For suspected fraud or abuse
  • To comply with legal or regulatory requirements

Termination does not relieve Users of outstanding obligations.


12. Disclaimers

The Platform is provided on an “as is” and “as available” basis.

Mahalli makes no warranties regarding:

  • Accuracy or reliability of listings
  • Availability or uninterrupted operation
  • Seller performance or Buyer conduct

Use of the Platform is at your own risk.


13. Limitation of Liability

To the maximum extent permitted by law:

  • Mahalli shall not be liable for indirect, incidental, or consequential damages
  • Mahalli’s total liability shall not exceed the amount of fees, if any, paid to Mahalli in the preceding 12 months

14. Indemnification

Users agree to indemnify and hold Mahalli harmless from any claims, losses, or damages arising from:

  • Use of the Platform
  • Violation of these Terms
  • Transactions between Buyers and Sellers

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Kingdom of Bahrain.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Bahrain.


16. Changes to Terms

Mahalli may modify these Terms at any time.
Continued use of the Platform constitutes acceptance of the updated Terms.
